Do I Need a Personal Injury Attorney for My Motorcycle Accident?

If you or someone you love got hurt in a severe motorcycle accident, hiring an experienced personal injury attorney is especially important. Your lawyer can investigate the crash, determine who is responsible, and seek full and fair compensation for your losses.

This includes expenses like medical bills, lost wages, motorcycle repairs, and more. They can also account for any post-traumatic stress, loss of enjoyment of life, and other non-economic damages.

The general public widely misunderstands motorcycle accidents. Many are quick to blame the biker, not the other motorist. This social stigma and the assumption that bikers are risk-takers makes it harder to secure compensation. A lawyer can build the most persuasive case to demonstrate how the other party caused the crash and injured you.

The attorneys at Schuler, Weisser, Zoeller, Overbeck & Baxter P.A. have handled motorcycle accident cases for countless clients like you. Let us put our experience and skills to work for you.

    Common Reasons for Motorcycle Accidents

MOTORCYCLE ACCIDENTS LAWYERS IN WEST PALM BEACH 2Motorcycle accidents can occur due to many unfortunate factors. Motor motorcycle accidents can happen because of driver errors (such as distracted driving). The other common reasons for these types of accidents include the following:

    • Drunk Driving: Inebriated driving is a dangerous and unlawful act that can pose a catastrophic danger to others on the road. Those who drive while intoxicated should be accountable for their poor judgment before getting behind the wheel of a vehicle.
    • Road Damage: Damage such as unpaved roads, potholes, cracks, or sinkholes pose significant risks to drivers. Especially when motorcycle riding, it can be challenging to avoid these types of road hazards. This is why they are common causes of motorcycle crashes.
    • Speeding: Driving above the posted speed limit can cause a motorcycle to go out of control quickly. Speeding reduces a driver’s ability to function at their best and can lead to collisions.
    • Auto Defects: Auto defects like issues with the steering system, airbags, or engine, commonly cause motorcycle accidents.

You shouldn’t be responsible for the financial burdens following an accident caused by a negligent party. At Schuler, Weisser, Zoeller, Overbeck & Baxter P.A., our motorcycle accident lawyers want to help you find the compensation and peace of mind you need after an accident.

    Motorcycle Accident Facts and Statistics

According to recent motorcycle accident data from the Florida Department of Highway Safety and Motor Vehicles (FLHSMV):

    • Overall, there were 584 motorcyclist fatalities in Florida in 2021. This was up 22 percent from 2020 when there were 484 motorcycle accident fatalities.
    • Of the 584 motorcyclists who died in 2021, 68 percent (396) were not wearing a helmet. Only 16 percent (92) were wearing a DOT-compliant helmet.
    • Among motorcyclists who suffered incapacitating injuries, 79 percent (1,434) were not wearing a helmet. In contrast, only 12 percent (217) of those with incapacitating injuries wore a DOT-compliant helmet.
    • Non-helmeted motorcyclists accounted for 40 percent of non-incapacitating injuries (1,307 of 3,226). Thirty-eight percent of possible injuries (655 of 1,747), and 44 percent of no-injury crashes (481 of 1,105).
    • On average, over the three years from 2019 to 2021, helmeted motorcyclists had a fatality rate of 1.72 per 100 million vehicle miles traveled (VMT). This is versus 5.51 for non-helmeted motorcyclists. This suggests helmets could reduce fatality risk by as much as 70 percent.
    • In Palm Beach County alone, there were 29 motorcyclist fatalities in 2021. This figure lined up with the county’s three-year average of 27 yearly fatalities. But motorcycle crashes in 2021 were up 2.6 percent versus 2020, outpacing the 1.8 percent statewide increase in motorcycle crashes.
