The off-duty Palm Beach County sheriff’s deputy, who Delray Beach police say caused a car crash that left a college student in a coma, has been issued two traffic tickets, Florida Highway Patrol records show.
Palm Beach County prosecutors said, they would not follow the recommendations made by the Delray Beach Police that the sheriff deputy be charged with two felony counts of reckless driving with serious injury. A memo said “evidence provided cannot prove all legally required elements for criminal charges in crash that injured Farrah Fox, 18, of Delray Beach, and Dylan De Giuseppe, 20, who lives west of Boca Raton.”
The crash occurred when the deputy ran the stop sign at Northeast First Avenue and Northeast Third Street and his 2018 Chevrolet Silverado pickup struck the Chevrolet Tahoe carrying Fox and De Giuseppe.
Fox, who had just finished her freshman year at the University of Central Florida and who plans to be an aeronautics engineer, remains in a coma and was transferred to a long-term rehabilitation facility in Central Florida, her father has said.
Her dad said, his daughter will continuing to work very hard but that he didn’t know when she’d be allowed to leave the rehab center. Even then, he said, she’ll continue outpatient rehab for quite some time.
De Giuseppe was taken to a nearby hospital. Police did not say if he has been discharged or not. Six passengers were in the cab of deputy’s pickup. FHP and four others were treated for minor injuries.
The two new citations charge the deputy with running the stop sign and traveling 53 mph in a 25 mph zone. They carry maximum fines of $166 and $281. He is set to appear at the Palm Beach County Courthouse in Delray Beach.
