Man Killed In A Deadly Car Crash, Tesla Sues For Autopilot Feature Failure
A Lake Worth family sued Tesla, alleging the technology in one of its cars is responsible for the death of a husband and father of three.
Jeremy Banner, 50, was killed when the Tesla he was driving slammed into a tractor-trailer in Delray Beach.
Police said, the tractor-trailer had run a stop sign and the Tesla drove underneath the truck, shearing off the roof.
The Banner family attorney said, Banner was using Tesla’s autopilot feature when the accident occurred.
The attorney said, the autopilot should have stopped the car before the collision.
“The way that it’s sold and marketed is that the car and computer is smarter, better than humans, that they should be able to stop quicker,” he said. “They should be able to react quicker than even we do. That’s not what’s happening.”
At a news conference, the attorney listed multiple other crashes he said were caused when the autopilot feature failed on other Teslas.
It’s unknown at this point if Banner had tried to stop the car manually before the accident.
Tesla declined to comment on the lawsuit, instead referring to a statement the company released about the accident:
“Shortly following the accident, we informed the National Highway Traffic Safety Administration and the National Transportation Safety Board that the vehicle’s logs showed that Autopilot was first engaged by the driver just 10 seconds prior to the accident, and then the driver immediately removed his hands from the wheel. Autopilot had not been used at any other time during that drive. We are deeply saddened by this accident and our thoughts are with everyone affected by this tragedy.”
Accident attorney Jason Weisser of Schuler, Halvorson, Weisser, Zoeller and Overbeck responded to this unfortunate crash. “This is a serious accident resulting in a fatality. We hope the investigators can quickly determine what caused the accident. Please be careful and obey the speed limits whenever you are driving a motorcycle, car, SUV or truck. We hope that all parties involved consult with an experienced trial lawyer. If you have been injured in an accident, call my office for a free consultation and find out what your rights are.”
