Do I Need a Personal Injury Attorney for My Motorcycle Accident?

If you or someone you love was injured in a severe motorcycle accident, it is especially important to hire an experienced personal injury attorney. Your lawyer will investigate the crash, determine who is responsible, and will seek full and fair compensation for the financial and emotional losses and harm you’ve suffered.

This includes expenses like medical bills, lost wages, damage to your motorcycle, physical therapy or rehabilitation, and payments for your ongoing treatments. Any post-traumatic stress, loss of enjoyment of life, and other non-economic damages will also be accounted for.

The general public widely misunderstands motorcycle accidents, and many are quick to place the blame on the biker, not the other motorist. This social stigma and assumption that bikers are risk-takers who know the dangers of their vehicles must be dealt with aggressively. Your lawyer will build the most persuasive case on your behalf and will demonstrate how the other party caused the crash and injured you.

The attorneys at Schuler, Weisser, Zoeller, Overbeck & Baxter P.A. have successfully handled motorcycle accidents for clients in a similar position as you. Let us put our experience and skill to work for you.

Common Reasons for Motorcycle Accidents

Motorcycle accidents can occur due to many unfortunate factors. Like other accidents, motorcycle accidents can happen because of driver error (such as distracted driving). The other common reasons for these types of accidents include the following:

  • Drunk Driving: Inebriated driving is a dangerous and unlawful act that can pose a catastrophic danger to others on the road. Those who drive while drunk should be held accountable for the poor judgment they made before getting behind the wheel of a vehicle.
  • Damage in Road: Road damage such as an unpaved or improperly paved road, potholes, cracks in the cement, or a sinkhole pose significant risks to drivers. Especially when driving a motorcycle, it can be challenging to avoid these types of road hazards, and this is why they are common causes of motorcycle crashes.
  • Speeding: Driving above the posted speed limit can cause a motorcycle to go out of control easily. Speeding reduces a driver’s ability to function at their best and can lead to collisions.
  • Auto Defects: Auto defects such as those affecting the steering system, airbags, or engine are commonly found to be responsible for many motorcycle accidents.

You should not be held responsible for the financial burdens following an accident caused by a negligent party. At Schuler, Weisser, Zoeller, Overbeck & Baxter P.A., our motorcycle accident lawyers want to help you find the compensation and peace of mind you need after an accident.

Motorcycle Accident Facts and Statistics

According to the most recent report by the Governors Highway Safety Association, the total number of people killed on motorcycles in 2017 was almost 300 less than the previous year. These saved lives represent a projected 5.6% decrease in motorcycle-related deaths. However, fatalities still occur 28 times more often on a motorcycle compared to a passenger vehicle.

An analysis conducted by the Insurance Institute for Highway Safety based upon a report from the U.S. Department of Transportation’s Fatality Analysis Reporting System revealed that this decline is attributed to a rise in helmet use. Helmets reduce the risk of death by about 37% in motorcycle accidents and reduce significant brain injury by about 67%.

The Florida Highway Safety and Motor Vehicles Department reported that in 2017, there were a total of 9,707oto motorcycle crashes compared to the 10,331 accidents that occurred in 2016. Of those crashes, there were a total of 515 deaths and 7,722 injuries in 2017, which makes Florida the most dangerous state in the U.S for motorcycle riders. However, the total number of motorcycle-related injuries represents a decrease of around 6% from the previous year.

The Florida report also revealed that of the total number of fatal crashes in Florida 264 people wore a DOT-compliant helmet, 10 wore some other type of helmet and 230 wore no helmet at all. Of those incapacitated, 1,045 people were wearing a helmet and 935 people wore no helmet. In instances where no injury was sustained to the rider, 608 people were wearing a helmet and 511 were not.

Overall in 2017, 89 percent of fatally injured motorcyclists were helmeted in states with helmet laws that cover all riders, in contrast to only 31 percent where states had no helmet laws. In states with helmet laws that cover only some riders, 42 percent of fatally injured motorcyclists were helmeted.

The Insurance Institute for Highway Safety also revealed that of the reported fatalities in 2017, 28% of victims were less than 29, 18% of victims were between 30-39, and 36% of victims were over the age of 50. Males overwhelmingly account for a majority of motorcycle fatalities, as 91% of motorcyclists killed in 2017 were males.

Engine size also factors into the potential for fatalities in motorcycle crashes. Of the riders killed in 2017, 92 percent on touring bikes had engines larger than 1,400 cc, while virtually all supersport bikes had engines sized 1,000 cc or smaller, which made up for 98% of fatalities in their class.

Forty-eight percent of motorcyclist deaths in 2017 occurred on weekends, with a majority occurring between the hours of 6-9 p.m. Of those who were involved in fatal crashes 28% of fatally injured motorcycle drivers in 2017 had a blood alcohol concentration at or above 0.08 percent, and in single-vehicle accidents, this number rose to 42 percent.
